The words of which the initial letter is capitalized have meanings defined under the following conditions. The following definitions shall have the same meaning regardless of whether they appear in singular or in plural.
Account means a unique account created for You to access our Service or parts of our Service.
Affiliate means an entity that controls, is controlled by or is under common control with a party, where "control" means ownership of 50% or more of the shares, equity interest or other securities entitled to vote for election of directors or other managing authority.
Application means the software program provided by the Company downloaded by You on any electronic device, named QwickTake
Company (referred to as either "the Company", "We", "Us" or "Our" in this Agreement) refers to QwickTake.
Country refers to: a nation with its own government, occupying a particular territory.
Device means any device that can access the Service such as a computer, a cellphone or a digital tablet.
Personal Data is any information that relates to an identified or identifiable individual.
Service refers to the Application.
Service Provider means any natural or legal person who processes the data on behalf of the Company. It refers to third-party companies or individuals employed by the Company to facilitate the Service, to provide the Service on behalf of the Company, to perform services related to the Service or to assist the Company in analyzing how the Service is used.
Third-party Social Media Service refers to any website or any social network website through which a User can log in or create an account to use the Service.
Usage Data refers to data collected automatically, either generated by the use of the Service or from the Service infrastructure itself (for example, the duration of a page visit).
You means the individual accessing or using the Service, or the company, or other legal entity on behalf of which such individual is accessing or using the Service, as applicable.
When you create an account and profile on the QwickTake Platform, we will ask You to provide Us with certain personally identifiable information that can be used to contact or identify You. Personally identifiable information may include, but is not limited to:
Topics you know or find interesting
First name and last name
Your name, photo, and any other information that you choose to add to your public-facing profile will be available for viewing by the public and other users of the QwickTake Platform. Once you create a profile, other users will be able to see in your profile certain information about your activity on the QwickTake Platform, such as the questions and answers you post, your followers and who you follow, topics of interest to you, the information you list as credentials, and your edits to your content.
Usage Data is collected automatically when using the Service.
Usage Data may include information such as Your Device's Internet Protocol address (e.g. IP address), browser type, browser version, the pages of our Service that You visit, the time and date of Your visit, the time spent on those pages, unique device identifiers and other diagnostic data.
When You access the Service by or through a mobile device, We may collect certain information automatically, including, but not limited to, the type of mobile device You use, Your mobile device unique ID, the IP address of Your mobile device, Your mobile operating system, the type of mobile Internet browser You use, unique device identifiers and other diagnostic data.
We may also collect information that Your browser sends whenever You visit our Service or when You access the Service by or through a mobile device.
While using Our Application, in order to provide features of Our Application, We may collect, with Your prior permission:
We use this information to provide features of Our Service, to improve and customize Our Service. The information may be uploaded to the Company's servers and/or a Service Provider's server or it may be simply stored on Your device.
You can enable or disable access to this information at any time, through Your Device settings.
We collect and store the information and content that you post to the QwickTake Platform, including your questions, answers, photos, comments. Unless you have posted certain content anonymously, your content, date and time stamps, and all associated comments are publicly viewable on the QwickTake Platform, along with your name. This also may be index by search engines and be republished elsewhere on the Internet in accordance with out Terms of Service. For more information about what you can change, see the below section on Your Choices.
When you communicate with us(via email, through the QwickTake Platform, or otherwise), we may maintain a record of your communication.
We use log files, pixel tags, local storage objects, and other tracking technologies to automatically collect information about your activities, such as your searches, page views, date and time of your visit, and other information about your use of the QwickTake Platform. We also collect information that your computer or mobile device provides to us in connection with your use of the QwickTake Platform such as your browser type, type of computer or mobile device, browser language, IP address, mobile carrier, unique device identifier, location, and requested and referring URLs. We also receive information when you view content on or otherwise interact with the QwickTake Platform.
We collect browsing information – such as IP address and location, date and time stamp, user agent, URL, unique advertising or content identifiers (if applicable), and time zone, and other information about user activities on the QwickTake Platform
The Company may use Personal Data for the following purposes:
To provide and maintain our Service: To provide you the services we offer on the QwickTake Platform, and make the QwickTake Platform available to the public, communicate with you about your use of the QwickTake Platform, respond to inquiries and for other customer service purposes.
To manage Your Account: To manage Your registration as a user of the Service. The Personal Data You provide can give You access to different functionalities of the Service that are available to You as a registered user.
Personilization: To tailor the content and information that we may send or display to you in the QwickTake Platform, to suggest followers and content, to help others find your profile, to offer location customization and personalized help and instructions, and to otherwise personalize your experiences while using the QwickTake Platform.
To contact You: To contact You by email, telephone calls, SMS, or other equivalent forms of electronic communication, such as a mobile application's push notifications regarding updates or informative communications related to the functionalities, products or contracted services, including the security updates, when necessary or reasonable for their implementation.
Advertising: To display interest-based advertising to you in the QwickTake Platform, to improve our advertising and measurement systems so we can show you relevant ads, to pre-fill forms in ads, and to measure the effectiveness and reach of ads and services.
Comply with Law: To comply with legal obligations, as part of our general business operations, and for other business administraion purposes.
For business transfers: We may use Your information to evaluate or conduct a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of Our assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which Personal Data held by Us about our Service users is among the assets transferred.
For other purposes: We may use Your information for other purposes, such as data analysis, identifying usage trends, determining the effectiveness of our promotional campaigns and to evaluate and improve our Service, products, services, marketing and your experience.
We may share Your personal information in the following situations:
Your information, including Personal Data, is processed at the Company's operating offices and in any other places where the parties involved in the processing are located. It means that this information may be transferred to — and maintained on — computers located outside of Your state, province, country or other governmental jurisdiction where the data protection laws may differ than those from Your jurisdiction.
Under certain circumstances, the Company may be required to disclose Your Personal Data if required to do so by law or in response to valid requests by public authorities (e.g. a court or a government agency).

You may update or correct your account information at any time by logging in to your account. You may also make a number of other adjustments to setting or to display of information about you as described in more detail in the following section about your Choices
You may, of course, decline to submit information through the QwickTake Platform, in which case we may not be able to provide certain services to you. You may also control the types of notifications and communications we send, limit the information shared within the QwickTake Platform about you, and otherwise amend certain privacy settings. Here is some further information about some of your choices:
Anonymous Posts You may post certain content anonymously, including questions and answers. In such event, your name is not displayed along with the content, and QwickTake does not associate such content with your user ID and other profile data.
Your Content You may edit or delete the answers that you post at any time. Any questions you have posted may remain on the QwickTake Platform and be edited by other users. Any deleted content will be removed from third-party sites from which it has been shared via QwickTake’s standard sharing features; however we have no control over deletions or changes to your content if it has been shared manually by others. When you make edits to your content, other users may be able to see the history of those edits in your profile activity and on content edit logs.
Adult Content In your profile’s privacy settings, you can elect whether to receive adult content.
Emails and Notifications When you join the QwickTake Platform by signing up for an account or creating a profile, as part of the service, you will receive email digests containing content from the QwickTake Platform that we believe may match your interests. You may also receive notices about other content from the QwickTake Platform that may be of interest to you, such as Spaces that you follow or that match your interests. In addition, users may be able to send communications and invites to their imported contacts through their QwickTake account, by email, text or phone. You can manage all your email and notice preferences in your account profile settings, under your Emails and Notifications settings. If you opt-out of receiving emails or other notifications about recommendations or other information we think may interest you, we may still send you transactional emails about your account or any services you have requested or received from us.
Followers You can block the ability of another QwickTake user to follow you by selecting the setting for this in the other user’s profile. You can change whether or not you follow other users.
Profile Discoverability You can adjust your settings to block others from discovering your account by searching for your name or using your contact information, including when another user imports their contacts from a third-party service.
Topics and Spaces You can change topics and Spaces that you are affiliated within your profile.
Deleted or Deactivated Account If you choose “Delete Account” in your profile’s “Privacy Settings,” then all of your content will be removed from public visibility on the QwickTake Platform, and it may not be restored by us, even if you change your mind. If you choose “Deactivate Account,” then you will no longer receive any communications from us, and users will not be able to interact with you; however your content will remain on the QwickTake Platform. Once you deactivate your account, you can reactivate it any time by choosing to log in.
As noted above, QwickTake gives users several easy-to-use ways to exercise choices about their personal information in the QwickTake Platform.
If you have registered with us and wish to access or update your profile, or exercise certain opt-out rights, you may do so online by visiting the “profile” settings in your account. In addition, users may also have the right to be provided certain personal information in a commonly used format where technically feasible, and, under certain conditions, to object to or restrict our use of certain personal information. You may also contact our privacy coordinator, as set forth below, to access or amend your personal information, to request that we rectify, delete or stop processing your personal information, to withdraw your consent to our processing, and, if you are an EEA resident, to exercise your opt-out rights or place a data portability request.
You also have the right to lodge a complaint with a supervisory data protection authority.
We will generally retain your profile and related personal information for as long as you have an account with us. If you wish to “be forgotten” by QwickTake (i.e., request the deletion of your personal information from QwickTake and the QwickTake Platform), you will need to delete your account (see “Your Choices” section above). If you delete your account, to the extent permitted by applicable law, we will retain and use your personal information as necessary to comply with our legal obligations, resolve disputes, maintain appropriate business records, and enforce our agreements. Further, any questions you post, threads you start, or other Your Content that other users have responded to or interacted with may continue to appear in the QwickTake Platform, but your user name will be removed from such content.
Our Service does not address anyone under the age of 13. We do not knowingly collect personally identifiable information from anyone under the age of 13 or under the age of majority in their respective jurisdiction (or under the age of 14 for anyone living in Spain or South Korea), or knowingly allow such persons to register. If You are a parent or guardian and You are aware that Your child has provided Us with Personal Data, please contact Us. If We become aware that We have collected Personal Data from anyone under the age of 13 or under the age of majority in their respective jurisdiction without verification of parental consent, We take steps to remove that information from Our servers.
If We need to rely on consent as a legal basis for processing Your information and Your country requires consent from a parent, We may require your parent's consent before We collect and use that information.
We have no control over and assume no responsibility for the content, privacy policies or practices of any third party sites or services.
California law permits users who are California residents to request and obtain from us once a year, free of charge, a list of the third parties to whom we have disclosed their personal information (if any) for their direct marketing purposes in the prior calendar year, as well as the types of personal information disclosed to those parties.
